{"id":158512,"date":"2022-01-04T11:59:40","date_gmt":"2022-01-04T11:59:40","guid":{"rendered":"https:\/\/other.kelsey.host\/amateurphotographer\/?p=158512"},"modified":"2022-01-04T13:35:44","modified_gmt":"2022-01-04T13:35:44","slug":"nirvana-cover-image-lawsuit-dismissed-for-now","status":"publish","type":"post","link":"https:\/\/other.kelsey.host\/amateurphotographer\/latest\/photo-news\/nirvana-cover-image-lawsuit-dismissed-for-now\/","title":{"rendered":"Nirvana cover image lawsuit dismissed (for now)"},"content":{"rendered":"<p>Last year we <a href=\"https:\/\/other.kelsey.host\/amateurphotographer\/latest\/photo-news\/nirvana-album-photographer-sued-by-the-baby-whos-now-30-152609\" target=\"_blank\" rel=\"noopener\">reported<\/a> how Spencer Elden, who appeared as a model on the cover of Nirvana\u2019s Nevermind album while still a baby, was suing former band members, photographer Kirk Weddle and several other parties for alleged sexual exploitation.<\/p>\n\t\t<div  class=\"c-caption aligncenter\" style=\"max-width: 710px\">\n\t\t\t<img loading=\"lazy\" decoding=\"async\" class=\"140371\" src=\"https:\/\/other.kelsey.host\/amateurphotographer\/wp-content\/uploads\/2020\/09\/Kirk-Weddle-1.jpg\" alt=\"\" width=\"690\" height=\"600\" \/>\t\t\t<p class=\"c-caption__text\">Photographer Kirk Weddle<\/p>\n\t\t<\/div>\n\t\t\n<p>As reported by <a href=\"https:\/\/www.spin.com\/2022\/01\/nirvana-nevermind-lawsuit-dismissed\/\" target=\"_blank\" rel=\"noopener\">SPIN<\/a>, a judge in California has now dismissed the lawsuit, albeit with \u201cleave to amend.\u201d Elden\u2019s lawyers apparently missed the deadline to contend a request from the Nirvana estate to dismiss the case back in December.<\/p>\n<p>His legal team now has until January 13th to file their opposition to this, and if they hit the deadline, the Nirvana estate has until January 27 to respond. So potentially, on it goes.<\/p>\n<img loading=\"lazy\" decoding=\"async\" class=\"152612 aligncenter\" src=\"https:\/\/other.kelsey.host\/amateurphotographer\/wp-content\/uploads\/2021\/08\/nevermind-album-1.jpeg\" alt=\"\" width=\"768\" height=\"768\" \/>\n<p>Elden\u2019s original lawsuit claimed he was the victim of child sexual exploitation. \u201cDefendants knowingly produced, possessed and advertised commercial child pornography depicting Spencer,\u201d said the lawsuit. Elden added he was unable to give permission for his image to be used as he was a baby and that his parents never gave him permission either As a result, the cover image caused him \u201cextreme and permanent emotional distress, plus loss of education, wages and \u201cenjoyment of life.\u201d<\/p>\n<hr \/>\n<p><strong>Further reading<\/strong><br \/>\n<a
