{"id":24116,"date":"2009-04-02T13:43:00","date_gmt":"2009-04-02T12:43:00","guid":{"rendered":"http:\/\/amateurphotographer.co.uk\/uncategorized\/parliament-debates-amateur-photography-and-terrorism-24116"},"modified":"2014-11-03T16:01:51","modified_gmt":"2014-11-03T16:01:51","slug":"parliament-debates-amateur-photography-and-terrorism","status":"publish","type":"post","link":"https:\/\/other.kelsey.host\/amateurphotographer\/latest\/photo-news\/parliament-debates-amateur-photography-and-terrorism\/","title":{"rendered":"Parliament debates amateur photography and terrorism"},"content":{"rendered":"<p><span class=\"hidePageBreak\"><\/span> Page 1 Photographers&#8217; rights raised in House of Commons<\/p>\n<p><strong>Amateur Photographer magazine&#8217;s campaign to defend photographers&#8217; rights reaches the dabating chamber of the House of Commons<\/strong><\/p>\n<p>The plight of <a href=\"http:\/\/amateurphotographer.co.uk\/news\/photographers_meet_home_office_minister_over_rights_abuse_news_278619.html\" title=\"Amateur Photographer meets minister\">innocent amateur photographers<\/a> who continue to be stopped by police under counter-terrorism laws was debated at length in the House of Commons yesterday.<\/p>\n<p><em>Amateur Photographer<\/em> magazine&#8217;s campaign to defend the rights of photographers to take picture in public places, unimpeded, was also <a href=\"http:\/\/amateurphotographer.co.uk\/news\/Parliament_debates_amateur_photography_and_terrorism_news_279909.html?offset=&amp;offset=1\" title=\"Amateur Photographer mentioned in the House\">mentioned in the House<\/a>.<\/p>\n<p>Conservative MP John Randall, a keen photographer, drew MPs attention to several incidents from his Uxbridge constituency, including the case of a man in his &#8217;70s who was stopped by a Police Community Support Officer (PCSO) while taking pictures in Windsor. <\/p>\n<p>Another involved a former member of the RAF who, said Randall, was stopped outside a shopping centre by a PCSO who ran a police check over the radio before confirming his innocence.<\/p>\n<p>Andrew Pelling MP then added his own personal experience to the list of police stops when he recounted an incident in which he was stopped for taking pictures of roadworks near East Croydon station.<\/p>\n<p>While Randall acknowledged the need for vigilance over terrorism, he added: &#8216;Common sense seems to have escaped police officers &#8211; or, very often PCSOs &#8211; in some of the cases.&#8217;<\/p>\n<p>Hugh Bayley, Labour MP for the City of York congratulated Randall on raising the debate. &#8216;I strongly agree that the ability to document what happens in this country through writing and photography is a fundamental civil liberty.&#8217;<\/p>\n<p>Randall supported the need for police to be issued with a <a href=\"http:\/\/amateurphotographer.co.uk\/news\/labour_mp_austin_mitchell_launches_photography_petition_in_parliament_news_197555.html\" title=\"Austin Mitchell launches petition\">photography code<\/a>, as proposed by Austin Mitchell MP last year.<\/p>\n<p>He also raised photographers&#8217; concerns over <a href=\"http:\/\/amateurphotographer.co.uk\/news\/pictures_hundreds_attend_photographers_rights_protest_update_news_277136.html\" title=\"section 76 Terrorism Act 2008\">section 76<\/a> of the newly introduced Terrorism Act 2008 which makes it a potential offence to take a photo of a police officer.<\/p>\n<p>&#8216;I understand that there is a fine balance to be struck between allowing people the right to take photographs and dealing with the other issues that we must consider? But there is a right for people to take photographs and we must ensure that it is not subsumed by hysteria and a state that has become too keen on surveillance,&#8217; said Randall.<\/p>\n<p>The government acknowledged the importance of the debate, a topic which it said has attracted &#8216;considerable interest&#8217;. <\/p>\n<p><img decoding=\"async\" src=\"http:\/\/keyassets.timeincuk.net\/inspirewp\/live\/wp-content\/uploads\/sites\/12\/2009\/04\/policeweb1.jpg\" title=\"Police at G20 demo, London\"><\/img><span class=\"hidePageBreak\"><\/span> Page 2 Government responds<\/p>\n<p><strong>Government defends terror laws<\/strong><\/p>\n<p>Shahid Malik, Under-Secretary of State for the Home Department told the House: &#8216;Our counter-terrorism laws are not designed or intended to stop people taking photographs. That is simply not their aim.&#8217;<\/p>\n<p>Referring to officers&#8217; right to stop-and-search members of the public, Malik added: &#8216;My hon. Friend the Minister for Security, Counter-Terrorism, Crime and Policing [Vernon Coaker MP] has met with several MPs and with representatives of <a href=\"http:\/\/amateurphotographer.co.uk\/news\/photographers_meet_home_office_minister_over_rights_abuse_news_278619.html\" title=\"Amateur Photographer meets minister\">Amateur Photographer<\/a> to discuss the issue. <\/p>\n<p>&#8216;He has also written to Ken Jones, president of the Association of Chief Police Officers, to ask him what steps are being taken to ensure that the revised guidance is being cascaded to all police officers on the street.&#8217;<\/p>\n<p>Responding to concerns raised over Section 76 of the new terrorism legislation Malik said: &#8216;It has been suggested that the new offence could criminalise people taking or publishing photographs of police officers. <\/p>\n<p>&#8216;A photograph of a police officer may fall within the scope of the offence, but would do so only in limited circumstances. The offence is designed to capture terrorist activity directed at members of protected groups which, sadly, we know occurs.<\/p>\n<p>&#8216;An offence might be committed, therefore, if someone provides a person with information about the names, addresses or details of car registration numbers of persons in the protected groups. <\/p>\n<p>&#8216;The important thing is that the photographs would have to be of a kind likely to provide practical assistance to terrorists, and the person taking or providing the photograph would have to have no reasonable excuse, such as responsible journalism, for taking it.&#8217;<\/p>\n<p>Malik confirmed that the Home Office plans to issue a circular concerning Section 76, to &#8216;all police officers&#8217;. <\/p>\n<p>?
