Hampstead Heath Constabulary has vowed to spell out the types of photography that require prior consent after Amateur Photographer<\/em> (AP) sought clarity over enforcement of a 1932 by-law that ensnared Guardian<\/em>\u00a0editor Alan Rusbridger<\/a>.<\/p>\n

City of London Corporation, which manages Hampstead Heath, yesterday said<\/a> that \u2018anyone is free to use tripods on Hampstead Heath as long as they get prior clearance\u2019, to avoid falling foul of the by-law.<\/p>\n

Currently, any commercial photography and filming requires prior permission, with or without a tripod, according to rules published on the City of London Corporation website<\/a>, where a fee applies.<\/p>\n

But ‘personal photography’ does not need prior clearance.<\/p>\n

However, the website guidelines make no mention of tripods, despite the 83-year-old by-law requiring all tripod users \u2013 both professional and amateur \u2013 to seek permission.<\/p>\n

Asked specifically about amateur tripod use, head of Hampstead Heath Constabulary Richard Gentry explained that officers do not expect them\u00a0to seek permission before using a tripod.<\/p>\n

In an interview with AP, he added: \u2018We do not have the time to manage all those amateur photographers wanting to take photographs.\u2019<\/p>\n

But he said there may be circumstances where an officer asks someone\u00a0for their personal details if they have previously been seen using a tripod, for example.<\/p>\n

\u2018He or she [the officer] may ask you for your name and address,\u2019 he confirmed.<\/p>\n

\"rusbridger\"<\/a>How the Guardian\u00a0reported Alan Rusbridger’s tripod clash on its website last week<\/em><\/p>\n

Gentry explained that officers have, at their discretion, a number of ways of dealing with a breach of the Hampstead Heath by-laws, taking factors such as obstruction or commercial photography into consideration.<\/p>\n

Gentry used an analogy of someone caught driving at 85mph on a motorway where there has clearly been a breach of the 70mph speed limit, but where police may choose not to take action.<\/p>\n

\u2018There are occasions where the by-laws are a wee bit antiquated,\u2019 he admitted, adding, \u2018There is no ban, per se.\u2019<\/p>\n

He explained that if an amateur is on a pathway, with photographic equipment, then they would probably be asked to move on because they were causing a potential obstruction.<\/p>\n

However, if the photographer returned the next day, an officer may then decide to take their name and address details even if, on this occasion, they are in an open area away from pathways.<\/p>\n

Gentry said such details are recorded \u2018to demonstrate who we are talking to and the type of incident we are dealing with\u2019.<\/p>\n

He said it also helps officers monitor whether a photographer is taking pictures for commercial use on a return visit, having previously denied this, for example.<\/p>\n\n

\u2018Secure database\u2019<\/strong><\/p>\n

Gentry\u00a0told AP that a\u00a0person\u2019s details may be held on a \u2018secure database\u2019 for up to seven years,\u00a0though\u00a0these would be accessible only to Hampstead Heath Constabulary officers.<\/p>\n

Whether personal details are sought in the first place would depend on individual circumstances.<\/p>\n

\u2018They could ask you for your name and address. It\u2019s highly unlikely they will\u2026 There may be just words of advice.\u2019<\/p>\n

Gentry stressed that an amateur would not be obliged to provide such\u00a0details and \u2013 unlike the Guardian<\/em> editor \u2013 they would not receive a written warning.<\/p>\n

Asked whether he believed that being asked for personal details could be an intimidating experience for the photographer involved, Gentry replied: \u2018We do not adopt a style of enforcement that would intimidate them.\u2019<\/p>\n

He added: \u2018I would expect my team to use common sense when dealing with photographers carrying camera apparatus.<\/p>\n

\u2018It\u2019s about staff being proportionate and using a bit of common sense\u2026\u2019<\/p>\n

Gentry said he did not have information to hand on how many photographers have been stopped while using tripods over the past year.<\/p>\n

In response to enquiries by AP, Gentry said he plans to change the wording on the City of London Corporation website, to \u2018make clear\u2019 what types of photography require permission.<\/p>\n

The 1932 Hampstead Heath bylaw<\/a>\u00a0also prohibits improper language and practising gymnastics.<\/p>\n

Guardian<\/em> editor Alan Rusbridger took responsibility for his photographer David Levene, who had been photographing him for an\u00a0article on climate change.<\/p>\n

Last night, a City of London Corporation spokesman told AP: \u2018We probably needed to explain to Mr Rusbridger that he needed to phone the [City of London Corporation] number…<\/p>\n

\u2018However, common sense clearly needs to prevail in these situations and we\u2019ll be in touch with Mr Rusbridger to explain the situation.\u2019<\/p>\n
