{"id":48048,"date":"2015-04-14T13:21:20","date_gmt":"2015-04-14T12:21:20","guid":{"rendered":"http:\/\/amateurphotographer.co.uk\/?p=48048"},"modified":"2015-04-27T14:33:54","modified_gmt":"2015-04-27T13:33:54","slug":"copyright-breach","status":"publish","type":"post","link":"https:\/\/other.kelsey.host\/amateurphotographer\/latest\/photo-news\/copyright-breach\/","title":{"rendered":"Disney accused of copyright breach over &#8216;fake&#8217; Hurricane Sandy photo"},"content":{"rendered":"<p>[Photo \u00a9 Karin Markert]<\/p>\n<p>It\u2019s a famous image of soldiers braving the elements that was mistakenly used by the world\u2019s media to report on Hurricane Sandy in 2012 \u2013 sending it viral in the process.<\/p>\n<p>Two-and-a-half-years on, photographer Karin Markert says her copyright in the image has been\u00a0routinely abused online by organisations including a website run by Disney.<\/p>\n<p>Karin\u2019s photo\u00a0of tomb guards in the rain \u2013\u00a0which reportedly attracted nearly a billion views inside a week \u2013 was taken at Arlington National Cemetery in Virginia.<\/p>\n<p>It was widely shared on Twitter after it was incorrectly labelled as a shot of three soldiers at the Tomb of the Unknown Soldier in the rain during Hurricane Sandy in October 2012.<\/p>\n<p>Many news organisations were quick to report that it had been captured during the hurricane, which had struck the East Coast of the USA.<\/p>\n<p>But it turned out they were wrong.<\/p>\n<p>The photo does show the Tomb of the Unknown Soldier. But it was captured during a storm a month earlier and <em>not<\/em> during Hurricane Sandy.<\/p>\n<p>The picture, which went viral after first surfacing on Facebook, is now caught in a fresh controversy.<\/p>\n<p>Karin Markert has a list of around 20 websites she says have infringed her rights over the image.<\/p>\n<p>Among them is a site called Babble, an online magazine and blog owned by Disney Enterprises Inc, based in Burbank, California (see below).<\/p>\n<p>\u2018I never gave them [Disney] permission to use it at all,\u2019 Karin told <em>Amateur Photographer<\/em> (AP) after discovering that the site is owned by Disney.<\/p>\n<p>\u2018It would have been nice of them to ask&#8230;<\/p>\n<p>&#8216;You would think Disney, more than most commercial companies, would better understand copyright infringement.<\/p>\n<p>&#8216;I absolutely did not give them permission to use my photo in that manner, or to repost a copy of someone else&#8217;s modified version&#8230;<\/p>\n<p>\u2018It\u2019s my photo, and people are still misusing it for their own purposes.\u2019<\/p>\n<p>Karin added: \u2018I contact people about using the photo. Only a handful ever respond, and fewer in a positive manner.<\/p>\n<p>\u2018I usually contact them just to see how they respond, as I\u2019ve actually lost faith that people care about the photographer\u2019s rights.\u2019<\/p>\n<p><a href=\"\/wp-content\/uploads\/2015\/04\/babble.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-48047\" src=\"\/wp-content\/uploads\/2015\/04\/babble.jpg\" alt=\"babble\" width=\"630\" height=\"571\" srcset=\"https:\/\/other.kelsey.host\/amateurphotographer\/wp-content\/uploads\/sites\/16\/2015\/04\/babble.jpg 630w, https:\/\/other.kelsey.host\/amateurphotographer\/wp-content\/uploads\/sites\/16\/2015\/04\/babble.jpg?resize=300,272 300w, https:\/\/other.kelsey.host\/amateurphotographer\/wp-content\/uploads\/sites\/16\/2015\/04\/babble.jpg?resize=441,400 441w, https:\/\/other.kelsey.host\/amateurphotographer\/wp-content\/uploads\/sites\/16\/2015\/04\/babble.jpg?resize=562,509 562w\" sizes=\"(max-width: 630px) 100vw, 630px\" \/><\/a> <em>The Babble website, owned by Disney, published the image under the heading &#8216;Serving with honor in a Hurricane&#8217;<br \/>\n<\/em><\/p>\n\n<p>The Babble website removed the page containing the offending image after A<em>mateur Photographer<\/em>\u00a0(AP) sought comment from Disney yesterday (see below).<\/p>\n<p><a href=\"\/wp-content\/uploads\/2015\/04\/disney.web_.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-48045\" src=\"\/wp-content\/uploads\/2015\/04\/disney.web_.jpg\" alt=\"disney.web\" width=\"630\" height=\"372\" srcset=\"https:\/\/other.kelsey.host\/amateurphotographer\/wp-content\/uploads\/sites\/16\/2015\/04\/disney.web_.jpg 630w, https:\/\/other.kelsey.host\/amateurphotographer\/wp-content\/uploads\/sites\/16\/2015\/04\/disney.web_.jpg?resize=300,177 300w, https:\/\/other.kelsey.host\/amateurphotographer\/wp-content\/uploads\/sites\/16\/2015\/04\/disney.web_.jpg?resize=562,332 562w\" sizes=\"(max-width: 630px) 100vw, 630px\" \/><\/a><em>Karin&#8217;s soldiers photo has now been replaced by a picture of Mickey Mouse.<br \/>\n<\/em><\/p>\n\n<p>The Walt Disney Company Ltd had yet to respond to emailed requests for comment at the time of writing.<\/p>\n<p>The photographer says she does not plan to take action against Disney, telling AP she believes\u00a0the potential cost would outweigh any possible benefit.<\/p>\n<p>Karin explained that her husband, Colonel James C Markert, was a former commander of the 3rd US Infantry Regiment when she took the photo of his soldiers in September 2012.<\/p>\n<p>\u2018What little I\u2019ve made through sales of this photo have been donated back to the unit, and more recently to the Society of the Honor Guard, Tomb of the Unknown Soldier.\u2019<\/p>\n<p>Though the photographer is normally the legal copyright holder, Karin urges photographers, in the US at least, to register copyright at the <a href=\"http:\/\/www.copyright.gov\/fls\/fl107.html\">US Copyright Office<\/a>.<\/p>\n<p>She also advises that photographers add a small \u2018\u00a9\u2019 symbol as a watermark, to direct viewers back to the original image and photographer, and to only post low-resolution images on the web.<\/p>\n<p>Karin is also calling for children to be educated about photographers\u2019 rights when using social media.<\/p>\n<p>She particularly resents the image being used for \u2018any political purposes\u2019.<\/p>\n<p>\u2018As long as the photo is appropriately displayed and shared, I don\u2019t get upset.
