{"id":54506,"date":"2015-06-23T14:37:53","date_gmt":"2015-06-23T13:37:53","guid":{"rendered":"http:\/\/amateurphotographer.co.uk\/?p=54506"},"modified":"2015-06-25T15:06:37","modified_gmt":"2015-06-25T14:06:37","slug":"photography-of-public-buildings-under-threat-after-european-rule-change-mep-warns","status":"publish","type":"post","link":"https:\/\/other.kelsey.host\/amateurphotographer\/latest\/photo-news\/photography-of-public-buildings-under-threat-after-european-rule-change-mep-warns\/","title":{"rendered":"Photography of public buildings under threat after European rule change, MEP warns"},"content":{"rendered":"<p><a href=\"http:\/\/amateurphotographer.co.uk\/latest\/photo-news\/campaign-launched-against-barking-european-plan-to-censure-photos-of-buildings-54628\">AP CAMPAIGN TO FIGHT &#8216;BARKING&#8217; EUROPEAN LAWS<\/a><\/p>\n<p>French MEP Jean-Marie Cavada proposed that all European nations adopt laws that may require permission from a building\u2019s architect before an image is published commercially, similar to strict photography rules currently in force in France, for example.<\/p>\n<p>According to German MEP <a href=\"https:\/\/juliareda.eu\/2015\/06\/fop-under-threat\/\">Julia Reda<\/a> this would mean countries currently protected by the so-called Freedom of Panorama, including the UK, would be subject to restrictions that would demand photographers seek a licence from the \u2018architect or rightholder of the public artwork\u2019.<\/p>\n<p>Reda went further by arguing that the rule change could have a far wider impact, by affecting people sharing images of iconic buildings on Facebook and those posted on Wikipedia.<\/p>\n<p>\u2018If the proposal by the European Parliament were adopted into law, all pictures of public buildings and permanent artworks depicting a work whose author has not been dead for 70 years would have to be deleted from Wikipedia,\u2019 she claimed.<\/p>\n<p>Giving his initial response, Michael Pritchard, director general of the Royal Photographic Society, told <em>Amateur Photographer<\/em>: \u2018It\u2019s a concern and one that should be addressed before it becomes law.\u2019<\/p>\n<a href=\"\/wp-content\/uploads\/2015\/06\/wikipedia.web_1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-54529\" src=\"\/wp-content\/uploads\/2015\/06\/wikipedia.web_1.jpg\" alt=\"wikipedia.web\" width=\"595\" height=\"353\" srcset=\"https:\/\/other.kelsey.host\/amateurphotographer\/wp-content\/uploads\/sites\/16\/2015\/06\/wikipedia.web_1.jpg 595w, https:\/\/other.kelsey.host\/amateurphotographer\/wp-content\/uploads\/sites\/16\/2015\/06\/wikipedia.web_1.jpg?resize=300,178 300w, https:\/\/other.kelsey.host\/amateurphotographer\/wp-content\/uploads\/sites\/16\/2015\/06\/wikipedia.web_1.jpg?resize=562,333 562w\" sizes=\"(max-width: 595px) 100vw, 595px\" \/><\/a>\n<p><em>The Signpost<\/em>, a community-run newspaper about Wikipedia (see above), warns the move will affect\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Wikipedia:Wikipedia_Signpost\/2015-06-17\/In_focus\">photography of buildings in the UK<\/a><\/p>\n<p>Reda had sought a Europe-wide adoption of Freedom of Panorama.<\/p>\n<p>But, instead, the European Parliament\u2019s legal affairs committee adopted \u2018the most restrictive amendment on the question of Freedom of Panorama\u2019, as follows: \u2018[The legal affairs committee] considers that the commercial use of photographs, video footage or other images of works which are permanently located in physical public places should always be subject to prior authorisation from the authors or any proxy acting for them.\u2019<\/p>\n<p>Francis Ingham, director general of the Public Relations Consultants Association, said: \u2018This decision from the European Parliament is a draconian attack on the UK\u2019s right to take photographs in public places. This is akin to the recent attack on our right to browse the internet without fear of impinging on copyright law\u2026<\/p>\n<p>\u2018Not only is this threat to \u201cFreedom of Panorama\u201d an attack on everyone\u2019s rights, it is an attack on the PR industry\u2019s work, which often depends on the ability to openly take and share photos and video footage in iconic public spaces.\u2019<\/p>\n<p>Reda urged people to lobby their MEP before the European Parliament votes on the proposals on 9 July.
