David Bellis last night made the photo his profile picture on his Facebook page<\/a> (above). It was taken by his son Jacob (pictured)<\/em><\/p>\n

David Bellis, from Prestatyn, Denbighshire,\u00a0had entered the controversial photo showing Betty the horse in the \u2018Made Me Smile\u2019 competition run by Thomson Holidays.<\/p>\n

Bellis said the photo \u2013 which sent social media<\/a> into a frenzy yesterday \u2013 was taken on a public footpath.<\/p>\n

Captured by David\u2019s three-year-old son Jacob, the selfie went on to win top prize, prompting the horse\u2019s owner Nicola Mitchell to reportedly claim she had the right to a share of the \u00a32,000 holiday.<\/p>\n

\u2018I was really annoyed to hear he had won a \u00a32,000 holiday and had used a picture of our horse without permission,\u2019 Mitchell was quoted as telling The Times<\/em> newspaper.<\/p>\n

\u2018It\u2019s not like it\u2019s just \u00a3100\u00a0\u2013\u00a0\u00a32,000 is a lot of money and would go a long way for a family\u2026\u2019<\/p>\n

However, despite her complaint, the Bellis family were last night declared legitimate winners.<\/p>\n

In a tongue-in-cheek response, a spokeswoman for Thomson today confirmed to Amateur Photographer<\/em>: \u2018Our Blue Monday competition was meant to make people smile on what\u2019s been deemed the most depressing day of the year [18 January].<\/p>\n

\u2018Despite questions over foal play, Mr Bellis and his family will be getting the \u00a32,000 holiday prize they won after entering our #\u200eMadeMeSmile competition.<\/p>\n
