{"id":90415,"date":"2016-08-02T13:19:52","date_gmt":"2016-08-02T12:19:52","guid":{"rendered":"http:\/\/amateurphotographer.co.uk\/?p=90415"},"modified":"2016-08-02T13:36:35","modified_gmt":"2016-08-02T12:36:35","slug":"getty-set-fight-1billion-copyright-lawsuit","status":"publish","type":"post","link":"https:\/\/other.kelsey.host\/amateurphotographer\/latest\/photo-news\/getty-set-fight-1billion-copyright-lawsuit\/","title":{"rendered":"Getty set to fight $1billion copyright lawsuit"},"content":{"rendered":"<p><em>&#8216;Nelson Atkins Art Museum, Kansas City, Missouri&#8217;<\/em> \u2013 <em>one of the images involved in the legal dispute <\/em>[Photo: Carol M Highsmith&#8217;s America, Library of Congress, Prints and Photographs Division]<em><br \/>\n<\/em><\/p>\n\n\n<p>The renowned American photographer claims Getty violated her rights for each of the 18,755 photos displayed on the Getty website.<\/p>\n<p>The copyright action concerns photos that Highsmith donated to the <a href=\"http:\/\/www.loc.gov\/loc\/lcib\/0712\/gift.html\">Library of Congress<\/a> in 1988.<\/p>\n<p>The archive documents people and places throughout the US.<\/p>\n<p>According to the lawsuit, the donation gave the public \u2018the right to reproduce and display all the photographs at issue in this lawsuit, for free\u2019.<\/p>\n<p>Highsmith claims Getty Images was purporting to sell licences for thousands of her photographs on commercial websites.<\/p>\n<p>The lawsuit, filed on 25 July at a United States District Court in New York, is seeking up to $1billion in copyright damages from Getty.<\/p>\n<p>The mammoth figure is based on the outcome of a previous case (Morel v Getty), which allows the court to treble the maximum $468,875,000 statutory damages sought, according to Highsmith\u2019s Dallas-based lawyers Carstens &amp; Cahoon.<\/p>\n\t\t<div id=&quot;attachment_90408&quot;  class=\"c-caption alignnone\" style=\"max-width: 447px\">\n\t\t\t<img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-90408\" src=\"\/wp-content\/uploads\/2016\/08\/26413a.web_.jpg\" alt=\"Photographer Carol M. We believe it is based on a number of misconceptions, which we hope to rectify with the plaintiff as soon as possible.
